Technology company Smartmatic filed a $2.7 billion lawsuit against Fox News on 4-2-21 for broadcasting false claims about the 2020 presidential election.
The 276-page complaint alleges that Fox News, following the lead of pro-Trump attorneys Rudy Giuliani and Sidney Powell, “joined the conspiracy to defame and disparage Smartmatic and its election technology and software.”
The lawsuit specifically cites instances of Fox News broadcasting interviews with Giuliani and Powell, as the attorneys made false claims about the company, including that it was created by Venezuela President Hugo Chávez and the Smartmatic software manipulated the vote count in favor of now-President Joe Biden. Such allegations are unsupported by any evidence.
“The Earth is round. Two plus two equals four. Joe Biden and Kamala Harris won the 2020 election… The election was not stolen, rigged, or fixed. These are facts. They are demonstrable and irrefutable,”
Dominion Voting Systems, another election technology company, recently filed lawsuits against Powell and Giuliani for similar claims.
Prior to these false claims, Smartmatic asserts it held a multi-billion-dollar enterprise value. Forecasts in the next five years allegedly projected $3.1 billion in revenue. For reputational and economic harm, the company is seeking no less than $2.7 billion in damages and requests a jury trial.
The suit filed by the company relies on the disparagement of the company by the various acts of media companies such as Fox News and some other politicians. Some of the 16 grounds for the cause of action taken include the following:
“Disparagement for False Statements and Implications that Smartmatic’s Election Technology and Software were Designed and Used to Fix, Rig, and Steal elections ……………………………………….. Disparagement for False Statements and Implications that Smartmatic Had Been Banned in the United States ……………….. Disparagement for False Statements and Implications that Smartmatic’s Election Technology and Software Were Used by Dominion during the 2020 U.S. Election……………………………. Disparagement for False Statements and Implications that Smartmatic’s Election Technology and Software were Compromised and Hacked during the 2020 U.S. Election ….. Disparagement for False Statements and Implications that Smartmatic’s Election Technology and Software Sent Votes Cast in the U.S. to Foreign Countries for Tabulation and Manipulation….etc.”
In the petition before the Supreme Court the company is seeking the following relief:
“754. Wherefore, Smartmatic prays for judgment against Defendants for each of the causes of action raised herein. Smartmatic respectfully requests a judgment in its favor and against Defendants for: a. Compensatory damages in an amount to be determined at trial; b. Actual, consequential and special damages in an amount to be determined at trial, but no less than $ 2.7 billion; c. Punitive damages; d. Reasonable and necessary attorneys’ fees; e. Reasonable and necessary costs of the suit; f. Prejudgment and post-judgment interest at the highest lawful rates; g. Declarative and injunctive relief; and h. Such other and further relief as this Court deems just and appropriate.”
